Current legislation
The donation of gametes and pre-embryos is defined as a free, formal and confidential contract agreed to between the donor and the authorised centre.
Hence there are three requisites for donation:
1. Free of charge. Donation is a free, altruistic act, for which compensation can only be made for physical trouble and travel and work costs that may arise from the donation âââ‰â¬Å economic reimbursement compensation. The reimbursement may never be of a lucrative or commercial nature.
2. 2. Formality. The contract between donors and the authorised centre must be shown in writing.
3. Anonymity. The donation is anonymous, and must guarantee the confidentiality of the data that identifies the donors. The children born have the right, by themselves or through legal representatives, to obtain general information about the donors such as height, weight, and blood group, but under no circumstances will their identity be included.
Requisites for being a donor:
1. Over 18 years old.
2. Good state of psycho-physical health. The demands of an obligatory study protocol must be met which will include the potential donorâââ‰â¢s phenotypical and psychological characteristics, as well as the clinical conditions and analytical tests necessary to demonstrate, according to the state of scientific knowledge and techniques existing at the time of carrying out the donation, that the donors do not suffer from genetic, hereditary or infectious diseases that may be transmissible to their descendants.
3. Full capacity to act.
Choice of donor.
It is the medical team that carry out selection of the donor, and they must attempt to guarantee the greatest possible phenotype and immunological similarities with the receiving woman.
Under no circumstances may the donor be personally selected at the request of the receiving woman.
